What is Military Divorce?

When one or both parties are serving in the military, it might result in a unique form of divorce known as a military divorce. Military divorces are uncommon because they have additional standards to be met, while being uncontested divorces in the majority of cases. When compared to the civilian population, divorces are less common.

Military Divorce Laws

Both state and federal laws apply to military divorce. For example, federal laws may dictate how military pensions are shared or where divorcing spouses wind up in court. In contrast, state laws may have an impact on the possibility of alimony and spousal support being awarded. Depending on the state in which the divorce is filed, specific state laws may apply to the divorce.

Jurisdiction

Military spouses or members must first have “jurisdiction,” or the right to the case, before a court can award a divorce. The location where a person resides typically determines the authority over them. However, even if a military member is stationed somewhere else, jurisdiction may still be the location where they have a valid address.

How to Divide Military Retirement Benefits

Military divorces are still subject to state property division laws. Federal law, however, also grants military personnel certain privileges concerning their American retirement benefits. How much of that account a former partner can receive will be governed by the Uniformed Services Former Spouses’ Protection Act. In fact, until a couple has been married for at least ten years, including military service, they are not eligible to receive direct payment from the military. When a spouse receives a portion of a military pension and their marriage lasts shorter than ten years, they must rely on their ex-spouse to make the payment. A court order may still be used to support this, but direct payment is unquestionably preferred.

Child and spousal support

The military has unique guidelines for child support and spouse maintenance (alimony). These regulations are intended to safeguard a service member’s ongoing family support duties after a divorce or legal separation.

There are several ways a court can make a party pay spousal and child support, including:

  • Court-order
  • Garnishment
  • Allotment, Voluntary or Involuntary

The paying spouse may also be required by the court to maintain life insurance that would cover alimony or child support payments for a predetermined amount of time.
